Federal law (the E-SIGN Act) and state law let us provide your loan documents electronically and let you sign them electronically — but only with your consent. This notice explains what you are agreeing to when you check the "I agree to the Electronic Consent" box in the online application or sign an electronic consent in store.

By consenting, you agree that we may provide the following electronically instead of on paper, and that your electronic signature has the same effect as a handwritten one:

  • Loan applications and loan agreements, including Truth in Lending disclosures (finance charge, APR, total of payments, payment schedule).
  • Privacy notices and this consent.
  • Account statements, payment receipts, payoff quotes and payment reminders.
  • Notices required by law, including right-to-cure notices, adverse-action notices and changes in terms.
  • Any other document or communication related to your application or loan.

2. How we deliver electronic records

Documents are delivered by email to the address you provide, by text message with a secure link, and in your online account at bearslending.com. Some notices required by law may also be sent by mail.

3. Hardware and software you need

  • A device with internet access and a current version of Chrome, Safari, Edge or Firefox.
  • A valid email address and, for text delivery, a mobile phone able to receive SMS.
  • Software to view PDF files (a free reader is available at adobe.com).
  • The ability to download or print documents if you want to keep copies.

If our requirements change in a way that would affect your ability to receive records, we will notify you and you may withdraw consent at no cost.

4. Paper copies

You may request a paper copy of any electronic record at any time, free of charge, by calling (855) 555-0199, emailing [email protected], or asking at any store. Requesting a paper copy does not withdraw your consent.

You may withdraw consent at any time by contacting us by phone, email or in store. Withdrawal takes effect after we have had a reasonable time to process it. It does not affect documents already provided electronically. If you withdraw consent before a loan is funded, you may need to complete the application in store.

6. Keeping your contact information current

You are responsible for keeping a valid email address and mobile number on file. Update them in your online account, by phone or in store.

By checking the consent box or signing this notice, you confirm that: you have read this notice; you can access and retain electronic records using the hardware and software described above; you consent to receive the records listed in section 1 electronically; and you agree that your electronic signature is binding.
