What happens if you can't repay a payday, title or installment loan on time

The honest answer is: it depends on the loan, the state, and whether you call before the due date. Here is what actually happens, step by step, and what a licensed lender is not allowed to do.

What happens if you can't repay a payday, title or installment loan on time

Missing a due date is common and rarely catastrophic — if the loan is with a licensed lender and you act before the date. This guide covers Bears Lending's policies, which follow Florida, Georgia and Alabama law; other licensed lenders in these states must follow the same statutes.

The one rule: call before the due date

Every option below — grace periods, repayment plans, moving a payment — requires you to tell the lender before the payment is due. After the date, fees and reporting clocks start and some statutory options expire. A two-minute call the day before is worth more than any amount of explaining the day after.

Payday loans

Florida: you're entitled to a 60-day grace period with no fees if you notify the lender before the due date and complete credit counseling within 7 days. No collection activity during the period. Alabama: ask for the repayment plan; the balance is split into installments with no new fee. Don't take the rollover, which adds a fee and changes nothing.

If a payday loan goes unpaid with no arrangement, the lender may deposit your post-dated check or run the ACH once, and a returned-item fee limited to the bank's actual charge may apply. After that the debt may go to collection and can be reported to credit bureaus.

Title loans and title pawns

Renew by paying the period charge, or pay down principal. If no payment is made, Georgia and Alabama law require written notice and a 30-day right to cure before any repossession. Bears Lending sends the notice by mail and text. Redeeming within the window costs the accrued charge only.

If the pawn is never redeemed the vehicle may be repossessed. Because it's a pawn, that closes the account: no deficiency balance, no collections, nothing reported.

Pawn loans

Nothing happens to you. If you don't redeem, the item is forfeited after the state holding period (30 days past due in Florida and Georgia) and the loan is closed. You owe nothing and nothing is reported.

Installment, personal and bad credit loans

Call before the date and Bears Lending can move a monthly payment once per loan at no charge, or set up a repayment plan. If a payment is missed with no arrangement, a late fee as listed on your agreement (limited by state law) applies, and a payment 30 or more days late is reported to the credit bureaus. The loan continues; the balance and remaining payments don't change.

What a lender cannot do

  • Threaten arrest or criminal charges. Loan default is civil; this threat is illegal in all three states.
  • Call before 8 AM or after 9 PM, or keep calling after you've asked them to stop in writing.
  • Contact your employer about the debt beyond confirming employment.
  • Charge fees not in the agreement or beyond state limits.
  • Repossess a vehicle without written notice and the right-to-cure period.
If any of these happen

The lender is either unlicensed or in violation. Document the call, then report it to your state regulator — the contacts are on our licenses page — and to the CFPB.

Getting out of a cycle

If you're re-taking a payday loan every two weeks, the fee is the debt. A consolidation or installment loan converts the balance into fixed payments that actually reduce it, and Bears Lending will refinance an open payday balance at any store.

Questions

Will one missed payment ruin my credit?

A single payment under 30 days late isn't reported. At 30 days it is, and it stays for seven years — which is why the pre-due-date call matters.

Can I be sued over a payday loan?

A lender can sue for a civil judgment on any unpaid loan, though small balances rarely are. Bears Lending offers a plan first in every case.

Does using the grace period hurt me?

No. It isn't reported and doesn't affect future loans with us.
